The Public Hearing was called to order by Council President Bob Matson with Mayor Moser, Jeff Kaiser, Teri Eiermann, Dave Kirk, Karen Clyde, Chuck Klamer, Solicitor Manlove, Don from the Record Courier, Valorie McCullough, and Rick Patrick and Linda Hartman for Nancy Baldwin.

 

 There was no discussion on Ordinance 2007-32, An Ordinance repealing Section 171.13 of the Codified Ordinances of the Village of Garrettsville which shall eliminate any credit to Village Taxpayers who pay municipal income tax to another municipality to be effective January 1, 2008.

 

There was no discussion on Ordinance 2007-35, An Ordinance amending Section 923.09 pf the Codified Ordinances of the Village of Garrettsville to increase Sanitary Sewer rates by 8% commencing on January 1, 2008 for the next three (3) years (2008, 2009, and 2010).

The meeting was called to order by Mayor Moser with Jeff Kaiser Teri Eiermann, President Bob Matson, Dave Kirk, Karen Clyde, Chuck Klamer, Solicitor Manlove, Don from the Record Courier, Valorie McCullough, Rick Patrick, Jackie Rinearson, and Linda Hartman for Clerk Baldwin.

 

Moved by Matson, seconded by Klamer to approve the minutes of the October 10, 2007 meeting as submitted by the Clerk.

Moved by Eiermann, seconded by Matson to pay the bills.

Revenue, Expenditure and Cash balance and Income Tax report were reviewed.

 

Mayor Moser asked that Ordinance 2007-32, An Ordinance repealing Section 171.13 of the Codified Ordinances of the Village of Garrettsville which shall eliminate any credit to Village Taxpayers who pay municipal income tax to another municipality to be effective January 1, 2008 be withdrawn.

 

Moved by Matson, seconded by Eiermann to withdraw Ordinance 2007-32.

Discussion was opened to Ordinance 2007-35, An Ordinance amending Section 923.09 of the Codified Ordinances of the Village of Garrettsville to increase Sanitary Sewer rates by 8% commencing on January 1, 2008 for the next three (3) consecutive years (2008, 2009, and 2010).

 

Karen Clyde expressed an interest in seeing a fund labeled Wastewater Treatment Expansion included on the financial statements of the Board of Public Affairs.  Bob Matson explained that this was already established under the name of Capital Improvements as this fund can only be used for Capital Improvements which is what the wastewater expansion would be.  Mayor Moser reported that the Board of Public Affairs was also looking into the possibility of decreasing the amount of water consumption used before the surcharge is assessed. 

 

Moved by Matson, seconded by Kaiser to approve Ordinance 2007-35.

NAYS-Clyde-Karen wanted to see an increase for one year

 

A motion was made by Karen Clyde and seconded by Matson to approve Ordinance 2007-42, A Resolution approving and accepting the Portage County Budget Commission’s Alternative Method of Apportioning and Distributing the Local Government Fund and Local Government Revenue Assistance Fund.

VOTE AYES-Unanimous

 

A motion was made by Karen Clyde and seconded by Klamer to suspend the rule that Ordinances be fully and completely read on three different days and that Ordinance 2007-43 be placed on first reading and passed.

A motion was made by Dave Kirk and seconded by Kaiser to pass Ordinance 2007-43, An Ordinance amending Ordinance 2007-12 entitled “Annual Appropriation Ordinance” to make appropriations for current expenses and expenditures for the Village of Garrettsville, State of Ohio during the fiscal year ending December 31, 2007.

VOTE AYES- Unanimous

 

A motion was made by Matson and seconded by Kirk to approve Resolution 2007-45 the contract for the Portage County Public Defender Service to Municipal Corporations.

A motion was made by Klamer and seconded by Kaiser to suspend the rule that Ordinances be fully and completely read on three different days and that Ordinance 2007-46 be placed on first reading and passed.

A motion was made by Kaiser and seconded by Klamer to pass Ordinance 2007-46 and Ordinance authorizing the Clerk of the Village of Garrettsville to transfer funds from certain accounts to balance the books.

A motion was made by Eiermann and seconded by Kaiser to accept the resignation of Grace Rinear from the Cemetery Board of Trustees.

A motion was made by Matson and seconded by Eiermann to accept the appointment of Mike Cook Sr. to the Cemetery Board of Trustees.

Mayor Moser told Council that the new copier for the Clerks office has been purchased from ComDoc for $6975.00 with the annual maintenance agreement cost of $430.00. The decision was made to purchase rather than lease as it would cost the Village less money.  Mayor Moser said that the Board of Public Affairs would also be asked to pay for half of the purchase.

 

A moment of silence was taken in remembrance of Veterans Day.

 

Ordinance 2007-38, An Ordinance adding Section 1163.06 of the Codified Ordinances of the Village of Garrettsville banning the use of Exterior furnaces in the Village of Garrettsville.  Read on second reading.

 

A motion was made by Matson and seconded by Clyde to approve Resolution 2007-47, A Resolution confirming the designation of Nancy Baldwin to attend the required training for public officials of the Village of Garrettsville.

VOTE AYES- Unanimous

 

Mayor Moser talked about the establishment of an Economic Development Committee.  Mayor Moser would act as chairperson with various community and business members; with the primary function to establish and open new business within the Village of Garrettsville.  The other members that would be asked are representatives to Council Teri Eiermann and Bob Matson, Business owners Jackie Rinearson, Chris Perme, and Pete Kepich, and Rick Patrick, and developer and resident Dave Harrington.

 

Mayor Moser also mentioned that he is in the process of contacting the owner of the Amweld property to establish communications and offer assistance from the Village to help find a new occupant for this property. Larry Cates was suggested as a contact for finding the owner.

 

Mayor Moser reviewed with Council the informational packet he submitted stating the next few years would be challenging financially with the loss of withholding revenue from Amweld even with the passage of the Income Tax levy.

Rick Patrick invited those in attendance to an evening get together on November 28th from 6-7:30 at Sugar Bush with light refreshments and a cash bar.  Charlie Abraham will be honored.  Saturday December 1st is the Christmas Social at the High School from 12-4PM.  The lighting of the Clock Tower and Christmas carols will begin at 6PM at the clock tower.

Jackie Rinearson extended an invitation to everyone to attend the Curtains Up production of “Papas Angels a Christmas Story” with shows on December 7th, 8th, 14th, and 15th in the Iva Walker auditorium at the High School. Tickets can be purchased from Jackie or through the Curtains Up website www.garrettvillecurtainsuptheatre.com.

 

The December Planning Commission and Design Review Board meetings have been changed to November 29th, 2007.

 

The next Board of Public Affairs meeting is December 10th and the Council meeting is December 12th, both in Council chambers.

 

Teri Eiermann asked that next years Trick or Treat night be shortened by one half hour.  Consideration would be made next October.

 

Bob Matson stated that Pre Disaster Mitigation Plan has been approved by the chiefs of Police and Fire and Ambulance.

 

Solicitor Manlove reported that the owners of the Eagle Creek Development Dave Harrington and Dick Bonner have requested that the Liberty Street sewer line assessments that were assessed originally to the property as a whole be divided amongst all of the lots in the Phase I part of the subdivision now that the property is sublotted.  Solicitor Manlove stated that only the sub lots, of which there are now six, along Liberty Street can be assessed as the assessment was based on the linear feet of frontage along Liberty Street. A Resolution amending the 2005 water line assessments will be drawn up along with the amortization schedules of each of the six lots and submitted to the Portage County Auditors office.

 

Mayor Moser congratulated Clerk Nancy Baldwin and Jeff Kaiser on their re-election and Rick Patrick on his election to Council.  Moser also thanked Dave Kirk for his years of service on Village Council.

 

Moved by Kaiser and seconded by Clyde to enter into Executive Session.  Rick Patrick was invited to attend as well.

 

Moved by Matson, seconded by Kirk to end Executive Session and to adjourn.
