Ordinance-2004-15, An
ordinance changing the zoning of 8145 High Street in the Village of
Garrettsville from R-2 to R-3 and amending the zoning map to reflect this
change.
Many residents on High Street
stated that they did not want the property changed from R-2 to R-3. Mike Mikula
said he has lived in the Village for twenty years and he feels that this is
spot zoning and once you start spot zoning it is hard to control. When the
house is fully rented it makes a different neighborhood. I know that the
Patrick’s would do a nice job but I don’t feel this is the place for
multi-family. Other residents stated that they did not want the value of their
property to decrease and they felt by changing the zoning it would affect the
value of their property.
President Bob Matson asked if
there were any more comments.

Kirk to end the Public Hearing and begin Regular Council.

Ordinance 2004-17, An
ordinance adding Section 1169.02(b)(11) to the Codified Ordinances of the
Village of Garrettsville to conditionally permit Open Space Development in the
R-1 District was to be read on second reading. Karen Clyde asked for this to be
sent back to Planning Commission for clarification and some changes she sent to
Solicitor Mark Manlove. Karen Clyde asked about the R-1 district having water
and sewer and would the 11/2 acres stay. Second reading will be heard at the
May Council Meeting.

Matson to send Ordinance 2004-17 back to Planning Commission for clarification
and changes.

by Klamer to approve Resolution 2004-20, A resolution authorizing the Village
of Garrettsville Income Tax Clerk to waive penalties and interest for Village
Income Tax for tax year 2003 if paid in full by

Mayor Moser read the bid for
the 1996 Chevrolet Caprice. The bid was
lower then the minimum bid required.

Klamer to reject the bid for the 1996 Chevrolet Caprice.

Mayor Moser read the bids for
the 2004 Paving Project. Perrin Asphalt was the lower bidder in the amount of
$71,463.00.

of $71463.00.

Barb Bejger asked Council if
$1500.00 could be used to purchase more flower baskets.

Mayor Moser appointed Bob Matson, Karen Clyde and Nancy Baldwin to work on
Policies and Procedures for the Village Employees.
Revenue, Expenditure and Cash
Balance Reports were reviewed.
There was discussion on where
the Skateboard Park should be. Dave Kirk said at the Planning Commission
meeting on April 8, 2004 there were properties reviewed and Planning Commission
would recommend the Park Avenue tennis court. Of the three tennis courts in the
Village the one on Park Avenue is in the worst shape. Ted Poole read a letter
to Council about his concerns with using the Park Avenue tennis court. There
would be a lack of supervision, there are no restrooms, and younger children
use the park to play. Roy Raab had a petition from residents on Park Avenue.
They do not want the tennis court on Park Avenue to be used for skateboarding.
The Skateboard Park should not be in a residential area the noise is annoying.
The Village Park on South Street is the perfect location. Terri Eiermann said
that the double tennis courts are visible and were built for the community. I
recommend the use of South Park we need a place so that we can apply for
grants. Gretchen Cram said that the skateboard park needs too visible and a
safe place for the kids. Gretchen Cram said the other problem with Park Avenue
is the schools kids use the tennis court. Teri Eiermann had a petition with 113
signatures from kids and families requesting a decision on where to put the
Skateboard Park. Karen Clyde asked about a gate the park closes at dark. Don
Craver said times have changed and the kids need somewhere to go. The tennis
courts do not get used all the time. Park Avenue the homes are to close to the
tennis court. The Village Park on South Street is noisy anyway due to baseball
games. The double tennis court at the Village Park on South Street is the
perfect place for the kids. Hallie Higgins said the Village parks are bought
for the community. If your house is next to a park you knew that when you
bought the property. Dave Kirk is concerned about kids skateboarding on
sidewalks and in the plazas even if they have a skateboard park they will
continue to do the wrong thing. I think if we have problems close the park for
one week and if problems continue we will not have a skateboard park. Barb
Walker said she didn’t like the comments because these kids have not caused any
problems. Rick Patrick said that the Village has been discussing this for the
past year. You are going to be here all night why not use the tennis court at
the Village Park on South Street on a temporary basis for a year. Jerry Kehoe said the Village Park on South Street
is better for these types of events. After a lengthy discussion it was decided
to use South Park.

by Matson to approve the Skateboard Park to be located at the Village Park on
South Street.

Bill Cline was present to
discuss the recycle center located at the Maintenance Department on Water
Street. He said he is really tired of the situation it is a dump. The Street
Department employees are always cleaning up the garbage. People put things in
the bins even if they are full. Could you please look for another location?
Karen Clyde said she has brought this issue up just about every meeting. Karen
Clyde, Stephanie Byrne and Gretchen Cram will look for a new location for the
Village recycle bins.
Rick Patrick told Council
that the Chamber will purchase two more benches for the Village. The Village
Garage Sales will be May 1, and
Teri Eiermann updated Council
on the Bicentennial Celebration.
Solicitor Mark Manlove
received a letter from Tom Reitz about the drainage issue and detention pond by
the high school. The school is going to try to correct the problem with Paul’s
and the Schultz’s. They would like to
pay the Village Maintenance employees to do the work and the school would pay
for all material. The Village would ask for a release from the Paul’s and
Schultz’s, if they do not sign the release the project will not move forward.
Karen Clyde asked why the letter stated that the plans and construction of the
retention pond were approved by Arcadis FPS. Solicitor Mark Manlove said he did
not agree with the letter.

Kirk to approve the work as long as a release is received from the Paul’s and
Schultz’s.
