The Public Hearings was called to order by President Bob Matson with Teri Eiermann, Dave Kirk, Chuck Klamer, Jeff Kaiser, Karen Clyde, Mayor Craig Moser, Solicitor Mark Manlove, Clerk Nancy Baldwin, Sandy Perdian, Hallie Higgins, Sandy Kreisman, Ed Vine, Dick Bonner, Mr. Peterson, Kathy Strope, Gretchen Cram, Stephanie Byrne, Frank Nedelka, Jeff Sheehan, Don Harvey, Steve Hardinsky, Jody Schroath from the Villager, a reporter from the Record Courier and other interested visitors.

Ordinance 2004-17 Version 2, An Ordinance adding Section 1169.02(b)(II) and Sections 1169.06-1169.068 to the Codified Ordinances of the Village of Garrettsville to conditionally permit Open Space Development in the R-1 District.

 

There was a discussion on Ordinance 2004-17 Version 2 with Bonner, Peterson and Harrington and Council concerning the useable space.  (Bonner, Peterson and Harrington were not reading Version 2.) Superintendent Jeff Sheehan said maybe Council should wait on passing the Ordinance.

 

Moved by Matson, seconded by Klamer to close the Public Hearing and begin Regular Council.

Moved by Kirk, seconded by Kaiser to approve the minutes of the June 9, 2004 meeting as presented by the Clerk.

Moved by Kirk, seconded by Kaiser to approve Ordinance 2004-17 Version 2, An ordinance adding Section 1169.02(b)(II) and Sections 1169.06-1169.068 to the Codified Ordinances of the Village of Garrettsville to conditionally permit Open Space Development in the R-1 District.

VOTE AYES—Eiermann, Matson, Kirk, Klamer, Kaiser

             NAY—Clyde Karen Clyde had questions on the amount of useable land and the sewer being available on Liberty Street.

 

Ordinance 2004-22 An ordinance amending Appendix c.3(h)(II) of the Codified Ordinances of the Village of Garrettsville in order to permit illuminated signs in limited circumstances. Read on second reading.

 

Moved by Matson, seconded by Klamer to suspend the rule that ordinances be fully and completely read on three different days and that Ordinance 2004-28 be placed on first reading and passed.

Moved by Klamer, seconded by Kirk to approve Resolution 2004-33, A resolution establishing an investment policy for the Village of Garrettsville with respect to investing funds on short term and long term basis.

Ordinance 2004-34, An ordinance to rezone 6.62 acres of vacant land on the north side of Windham Street (State Route 82) in the Village of Garrettsville from R-1 to C-2, amending the zoning map to reflect this change. Read on first reading.

 

There were two candidates for the opening on the Design Review Board, Gretchen Cram and Sandy Kreisman.

 

Moved by Kirk, seconded by Clyde to appoint Gretchen Cram to the open Council appointed position on the Design Review Board.

VOTE AYES—Unanimous

 

Sandy Kreisman asked Council why she was not chosen for the position. What is your reasoning? Mayor Moser told Sandy she could speak with Council members in private. Sandy Kreisman feels she was more qualified for the appointment. Sandy Kreisman said the most qualified person should get the job. I want to know what the reasoning is. Mayor Moser told her Council had voted and made a decision and that the decision would stand and if she had any questions she could speak with Council if private. Sandy Kreisman said she wanted to know the reason in public. Mayor Moser said the subject is closed. Karen Clyde thanked Sandy Kreisman for interest and said she hoped that Sandy would become involved in the Village in another capacity. Sandy Kreisman said she could hope all she wanted. Sandy Kreisman asked Chuck Klamer how he could do this to the children in the Village. Sandy Perdian said that the residents of Garrettsville would want the most qualified person to have the position. Mayor Moser said the subject is closed and there would be no more discussion on this matter. Sandy Kreisman said this matter better be in the minutes she then left Council Chambers and Sandy Perdian followed her.

 

There was discussion on a new phone system for the Clerk’s office. Council reviewed information from different companies. Avaya was the low bid on the phone system.

 

Moved by Kirk, seconded by Klamer to approve a new phone system from Avaya at a cost not to exceed $5100.00.

VOTE AYES—Unanimous

 

There were no bids received on the 1995 Toyota Truck that the Police Department had for sale. The truck has been advertised twice Solicitor Mark Manlove wrote a recommendation to allow the Police Department to sell the vehicle for the highest amount. (See attached letter.)

 

Moved by Matson, seconded by Kirk to approve the recommendation by Solicitor Mark Manlove to sell the Toyota truck for the best price and authorizing the Chief of Police to proceed with the sale.

VOTE AYES—Unanimous

 

Mayor Moser thanked all members of the Bicentennial Committee for a great job.

 

Dave Kirk announced that the Village of Windham is considering becoming part of the EMS District. The issue will be on the ballot in August for a special election. Dave Kirk discussed parking on Main Street; there is no parking from 2:00 am until 6:00 am. There are businesses open until 2:30 am. This issue will be brought up at the next Safety Committee meeting in August.

 

Chuck Klamer told Council that sidewalk letters would be sent to property owners.

 

Jeff Kaiser discussed the Regional Planning Commission meeting there was discussion on HB 278, which governs oil and gas regulations he asked Council to read HB 278.

 

Karen Clyde discussed the status of the Employee Manual and Income Tax Penalty. The Dumpster Ladies (Karen Clyde, Stephanie Byrne and Gretchen Cram) have spoke with Thermo Link and they agreed to place the recycle containers on their property. Their attorney asked a question on liability. Karen Clyde asked Solicitor Mark Manlove to contact Dave Campbell to discuss the situation.

 

Moved by Eiermann, seconded by Clyde to adjourn.
