The Public Hearing was called to order by Council President Bob Mastson with Mayor Craig Moser, Jeff Kaiser, Teri Eiermann, Chuck Klamer, Dave Kirk, Karen Clyde, Solicitor Mark Manlove, Dale Gillespie, Hallie Higgins, Stephanie Byrne, Judy and Nelson Bisard, Jan Boehm, Connie Knop, Helen Danku, Doug & Colleen Veits, Susan North, Terry Gallagher, Steve Wassel, Steve Hadzinsky, Rick Patrick, Dan Leavengood, Dan Meyers, Rachael Hartman, Jerry Kehoe, Delma Mishler, Matt Jordan, Jim Proctor, Sandy Kreisman, Laura Young, Jeff Csorba and son, Linda Hartman for Clerk Baldwin and two other interested parties.

 

Ordinance 2004-22, An Ordinance amending appendix c.3 (h) (II) of the codified ordinances of the Village of Garrettsville in order to permit illuminated signs in limited circumstances and repealing all prior inconsistent ordinances.

 

Judy Bisard presented a letter to Council and read it to the audience explaining her concerns and opposition to illuminated signs being added to the Preservation District.  Helen Danku read a letter from the Historical Society to Council expressing similar opposition to the illuminated signage ordinance. Council also considered a written letter Zoning Inspector Jan Boehm had submitted to Council prior to the meeting with suggestions to clarify the current ordinance.  After comments from other guests both for and against and in response to the submitted letters Bob Matson moved that the Public Hearing be closed and the Regular Council meeting begin.

 

Moved by Matson, seconded by Klamer to close the Public Hearing and begin the Regular Council meeting.

Moved by Clyde, seconded by Kirk to approve the minutes of the July 14th, 2004 meeting as presented.

Ordinance 2004-22, an ordinance amending Appendix c.3 (h) (II) of the Codified Ordinances of the Village of Garrettsville in order to permit illuminates signs in limited circumstances. 

 

Mark Manlove clarified the issue of grandfathered businesses pertaining to this ordinance by correctly calling the situation a non-conforming use with only Silver Crik Saloon on Main Street falling into that category. A second clarification was made in response to many of the businesses having entrances on both Main Street and the Board Walk. Solicitor Manlove stated that having entrances on both sides gives the property owner only the allowances set forth by the current signage ordinances and the proposed illuminated sign ordinance.  Both entrances cannot be used as separate applications. Bob Matson had concerns about the possibility of businesses being added above each other such as in the instance of the office building at the 8138 block of Main Street. Solicitor Manlove stated that Planning Commission would have to address the situation just as it would any other sign application.

 

Moved by Kirk, seconded by Eiermann to approve Ordinance 2004-22 permitting illuminated signs in certain instances.

Ordinance 2004-34 An ordinance to rezone 6.62 acres of vacant land on the north side of Windham Street (state route 82) in the Village of Garrettsville from R-1 to C-2, amending the zoning map to reflect this change and repealing all prior inconsistent ordinances.  Read on second reading with a public hearing to be held before the next Council meeting September 8th at 7:30.

 

Moved by Klamer, seconded by Eiermann to approve Resolution 2004-35, A resolution authorizing the clerk of the Village of Garrettsville to request the Portage County Auditors to remove an assessment in the sum of $886.01 placed on parcel number 19-002-00-00-020-000 owned by Denny and Sue Hamilton (8252 Water Street) for delinquent water/sewer charges.

Moved by Eiermann, seconded by Kirk to approve Resolution 2004-36, A resolution authorizing the Clerk of the Village of Garrettsville to request the Portage County auditor’s to remove an assessment in the sum of $1070.60 on parcel number 19-016-00-00-083-000 owned by George Bisset (10717 South Street) for delinquent water/sewer charges.

The Toyota Tacoma was sold to Mike Dye for $1200.00

 

Moved by Matson, seconded by Kaiser to accept a $498.65 donation from the Theodore Lind family (previously deposited) to be placed in the cemetery fund.

Teri Eiermann reported that Barb Walker of the skateboard committee has raised $2000.00 so far for equipment and more fund raisers were to come.

 

Chuck Klamer reported that the sidewalk project would begin in the next few days.

 

Solicitor Manlove reported that he was unable to speak with Dave Campbell about the definite use of the Thermo Link property as the new sight for the recycle dumpsters. 

 

Council asked that as a result of the passage of Ordinance 2004-22 that the Zoning inspector take pictures of the existing illuminated signs at the Silver Crik Saloon and keep them for record.  Council also added that within 60 days each business on Main Street should receive a copy of Ordinance 2004-22 along with a notification that any signage not in compliance be removed immediately until a permit, proper fees, and a picture of the illuminated sign have been submitted and approved through the Zoning Inspector.

 

Rick Patrick invited everyone to attend the last Cruise Night and Peach Social for the year on Saturday August 14th at the Fire Station.
