The Public Hearing was called to order by President Bob Matson with Teri Eiermann, Dave Kirk, Chuck Klamer, Jeff Kaiser, Karen Clyde, Solicitor Mark Manlove, Clerk Nancy Baldwin, Butch Seiler, John Porter, Bill Cline, Marsha Porter, Jason Hamilton, Sandy Perdian, Gary Carpenter, Bob O’Bryan, Jack Schultz, Rick Patrick, Charles Ramer, Stephanie Bryne, Valorie McCullough, Howard Perusek, members of the James A. Garfield football team, Jody Schroath from the Village and Tom Pursha from the Record Courier and other interested visitors.
Ordinance 2005-39, An ordinance adding Section 1191.02(l) Flashing Signs or Signs with Flashing Lights to the Codified Ordinances of the Village of Garrettsville to regulate and permit some flashing signs in certain Commercial Districts.
Ordinance 2005-40, An ordinance amending Section 1191.04(b)(1) relating to Movement of Signs.
Ordinance 2005-41, An ordinance amending Section 1191.04(p) Changeable or Animated Copy Signs of the Codified Ordinances of the Village of Garrettsville to clarify this section.
No comments on Sign Ordinances.
The issue of curbside recycling vs. the collection bins at the Village Maintenance garage was discussed. John Porter presented his letter that had 20 or more signatures from residents that were opposed to curbside. John Porter discussed the benefits of having the bins at the Village Maintenance garage, the bins are visible and the Village employees help to keep the area clean. Curbside would also impose hardships on some residents. It should not be mandatory. Butch Seiler and Rick and Lynette Patrick were also opposed to curbside recycle. Sandy Perdian lives directly across form the Village Maintenance department she said she had no problem with the recycle center location. Bob O’Bryan on the other hand said that he has lights from cars shining in his home and loud music can be heard at all hours of the night. He is not in favor of curbside recycle but feels that the bins should not be in a residential area. He asked Council when the zoning was changed to allow the collection bins at the maintenance garage. Solicitor Mark Manlove said he was not sure but he would look into the situation. Karen Clyde said she tried to find a different location for the recycle center but was unable to find anyone or any business that wanted it on their property. Stephanie Byrne said she was never asked whether she wanted the bins in her neighborhood. She is in favor of curbside recycle. Charles Ramer was asked about curbside he stated that Garrettsville was one of the last Villages to have the collection bins. He said it is matter of opinion on which way you decide. Sandy Perdian asked Council what the cost was for the current recycle bins. The cost is $3000.00 per year and curbside would be $28,000.00 to $34,000.00 per year. Howard Perusek lives right across from the recycle bins and he was glad to have the recycle center and that it is getting better every year. Jack Shultz said his mother-in-law lives in Hiram and has to pay even though she does not use the curbside. Older residents would not use curbside but would still have to pay for it. Bill Cline said he opposes curbside but on holiday weekends the containers are a mess. Charles Ramer said that has been a problem and maybe they could try to have a Saturday pick up. After a lengthy discussion the Public Hearing was closed.

Moved by Matson, seconded by Kaiser to approve the minutes of the October 12, 2005 meeting as amended by the Clerk. (Jeff Kaiser voted nay on PARTA).

Revenue, Expenditure and Cash Balance reports were reviewed.
Mayor Moser noted that the cash balance is holding and asked Council to attend a Work Session on November 30, 2005 at 7:00 pm to discuss finances for 2006.

Mayor Moser recommended that Council approve his appointment of Nelson Seiler to the Board of Zoning Appeals due to the resignation of Ed Seigerst.

Ordinance 2005-42, An ordinance of assessment pursuant to Section 727.25 of the Ohio Revised Code establishing assessments for the Liberty Street Waste Water Line Installation Project as set forth in Resolution 2005-30 assessing the property owners the sum of $102,133.07 to be assessed as set forth herein. Read on first reading.
Moved by Matson, seconded by Eiermann to approve Resolution 2005-54, Northeast Ohio Public Energy Council Proxy.

Moved by Klamer, seconded by Matson to approve Resolution 2005-55, A resolution commending the 2005 James A. Garfield Coaching Staff and Football Team for winning the Portage Trail Conference County Division Championship.

Moved Kirk, seconded by Kaiser to approve Resolution 2005-56, A resolution commending Ed Seigerst for his seventeen years of service as a member of the Board of Public Affairs and Board of Zoning Appeals.

Mayor Moser commended Ed Seigerst for a job well done for the Village of Garrettsville.
Moved by Matson, seconded by Clyde to approve Resolution 2005-57, A resolution authorizing the Clerk/Treasurer of the Village of Garrettsville to authorize the sale of various equipment that the Village no longer has any use for.

Mayor Craig Moser discussed the resignation of Ed Seigerst and would like anyone who is interested in the open position on the Board of Public Affairs to send a letter with qualifications for the position to the Clerk’s Office by November 18, 2005.
Mayor Moser congratulated Council members on the election.
Mayor Moser asked Council to enter into Executive Session to discuss acquisition of property and personnel.
Moved by Matson, seconded by Eiermann to enter into Executive Session for reasons of property acquisition and personnel.

Teri Eiermann updated Council on the Portage County Bicentennial Committee. Teri added that anyone interested in helping is welcome.
Bob Matson told Council the new stone at the Veteran’s Memorial is in place. There are still some names to be added to other stones. The rescue truck is on the way to be repaired.
Dave Kirk thanked the voters.
Rick Patrick discussed the Christmas Social that will be
held
Mayor Moser told Council that the traffic light controller is now working, the oil separator and concrete is done at the Police Department. November 11, 2005 is Veterans Day stop at the Veterans Memorial. Thanks to Police Department for a good job on Halloween night.
